ActingonthedescriptionprovidedbytheneighbourandtheimagesoftheAccusedonthevideofootage, DetectiveSeniorSergeantClaudetteWYMSobtainedandexecutedonThursday26August2021asearch warrantthatauthorizedhertoleadasearchoftheresidentialpremisesoftheAccusedat5FarmRd, Newcastle.InthecourseofthatsearchablacksuitcaseandthecomponentsandcasingofanAppleLisa2 personalcomputer.Thecomputerhadevidentlybeendisassembledafteritwasremovedfromthegarage, asthedisconnectedcomponentscouldnotfitwithinthesuitcase.Abriefinvestigationdeterminedthevalue ofafunctioningAppleLisa2tobesomewherebetween$2000and$4000.Itisextremelyunlikelythatthe computerwouldfunctionifreassembled,giventheageofthecomponentsandthesignificantexpertisethat isrequiredtoremedymalfunctionsinsuchanoperatingsystem. DetectiveSeniorSergeantWYMSthenarrestedtheAccusedandtookhimtoNewcastlePoliceStation wherehewascautionedandinterviewedontheafternoonof26August2021.Duringthatinterviewthe Accusedclaimedthatthegaragedoorwaspartlyopenwhenheapproachedit,andthathewasableto leveragethedooropenbyplacinghishandundertheedgeofthepartiallyopendoorandliftingit upwards.TheAccusedalsoclaimedhewasattemptingtoidentifywhethertheAppleLisa2wasonethat hadbelongedtoanunidentifiedpersonfromwhomthepropertyhadbeentakenatsomepointinthe precedingweeks.AlternativelytheAccusedpositedthat,shouldthecomputerprovenottobethatwhich hadbelongedtotheotherperson,theywouldhavereturnedit.However,theAccusedrefusedtoprovide anydetailsthatwouldallowtheidentificationorlocationofthepersonsaidtobethetrueownerofthe AppleLisa2computer. TheAccusedwasreleasedwithoutchargeattheconclusionofthatinterview. OnFriday27August2021DetectiveSeniorSergeantWYMSreturnedtothepremisesat3RampartSt,Cook Hillforthepurposesofexaminingthegaragedoor.Herexaminationfoundthatthedoorwasundamaged.It appearedthattherighthandsideofthedoorwastouchingthegroundwhenthedoorwasclosed.However, thelefthandsideofthedoorwassittingapproximately2cmsabovethelevelofthegroundwhilethedoor wasclosedandlocked.Thebottomofthedoorappearedtobeeven,andDetectiveSeniorSergeantWYMS tookphotographsthatshowthegroundimmediatelybelowthegaragedoorwasuneven. Asof27August2021Policehaveconductedathoroughexaminationoftherelevanteventsandproperty. ItappearsfromthestatementsoftherelevantwitnessesandtheCCTVfootagethattheAccusedhadevery intentionofremovinganitemofpropertyfromthegarageatthepremisesat3RampartSt,CooksHilland therebydeprivingthetrueownerofthem.
