The task will be to determine the scope of legal and ethical compliance requirements and responsibilities by completing an action plan on how you develop, communicate, implement and evaluate the required policy document based on the case scenario using the action plan template .
Justin is an aged care worker at the Middle Grounds Aged Care facility. Justin is 23 years old and loves his technology devices, Facebook and surfing the internet.
Today Justin is providing support care for Marcus an 89-year-old with Congestive heart disease and pressures areas on his right and left hip bones so requires constant pressure area care and positioning.
Justin was about to reposition Marcus when he decided instead to sit down and use the computer to input some health assessment data for his clients. No one is around and he decides to check the internet for some cheap flights for a trip away he is planning, his phone rings and so he decides to also check his phone to talk to his friends. While talking to his friends Justin surfs the net to check out places of interest for his holiday destination and flight details. After Justin makes some inquires on the internet using his personal email he books his flights and organises his holiday accommodation.
Justin was distracted in completing these tasks for approximately 55mins but he did not realise this until he went to reposition Marcus and found that Marcus’s previously intact skin had now broken down on his right hip as he had not been turned for 3hrs. Justin is not that concerned and decides to take a photo of Marcus’s injury and posts this on Facebook with the tag line “getting old sucks if you can’t move, see what happens only after 3 hrs, you literally fall apart”.
Justin’s supervisor Donna is listening to handover of the clients to the afternoon shift and hears Justin provide information about the change in skin integrity of Marcus’ right hip pressure area. Donna asks Justin how this skin breakdown occurred as he was supposed to turn Marcus regular to avoid such an injury occurring.
Justin joked that it was probably due to being busy with other clients and not getting to turn Marcus at the allocated times.
Donna goes to use the same computer that Marcus was on and notices that a web browser is still open. When she goes to close the browser, she notices that that the webpage is for a flight booking in Marcus’s name ready of r printing.
The next day Justin’s supervisor Donna is informed by her colleagues that Justin has posted a Facebook comment and image on his personal Facebook page of Marcus’s injury which clearly identifies Marcus in the image.
Middle Ground Aged Care calls a meeting with Justin to explain his behaviour, breach in code of conduct, data breach of a client condition and ethical behaviour which results in instant dismissal for Justin. Middle Ground Aged Care was unsure about the consequences of his breach of using the work computer and internet for personal use and the use of social media use on work time as the organisation did not have a policy surrounding these issues as the organisation had not had a problem with such issue organisation previously.
The organisation sees the consequences of “cyberloafing” can range from brief employee distraction resulting in neglect of clients to a drain on organisational resources or security (for example, slower network performance or computer viruses). The organisation wishes to continuously improve their position on such breaches by requesting Donna have her senior aged care support workers develop a Technology policy and procedures document for the organisation to follow of what’s acceptable and what’s not in regards to Internet, email and social media usage for personal purposes at work so that all workers will be clear about legal and ethical considerations when using technology and what is considered a breach of the standards.
This assessment task requires the student to provide evidence of the development of the policy and procedure outlined in the case scenario.

This assessment task requires the student to submit a report that demonstrates their ability to develop a strategic response in situations were the legal and ethical requirements have been breached. The assessment task is based on 3 situations from the case scenario provided in Task 1.
